Abstract: The association between labor supply and laws related to marriage and divorce has previously been analyzed both theoretically and empirically. Most of these studies have focused on effects of changes in divorce laws. This paper investigates whether availability of common law marriage (CLM henceforth) in the U.S helps explain variation in the labor force participation and hours of work of men and women over time and across states. To the extent that CLM facilitated specialization and trade in households following traditional gender roles the abolition of CLM could help explain some of the gender convergence in labor supply and time in household production that has been observed in recent decades. In addition we also investigate the association between CLM and hours of household production.
